⚠️ Draft. This document was written by the engineering team to reflect how the app actually works and to satisfy App Store and Google Play requirements for paid subscriptions. Have a lawyer review before publishing, especially the disclaimers, limitation-of-liability, and governing-law sections, and any consumer-protection rules in the jurisdictions you serve.
Plain-language summary
- - everQUIN is a self-knowledge and practice tool. It is not medical, psychological, or crisis care.
- - The canon and the 90-day practice are free. Becoming a Patron (subscription) or buying the Lifetime unlock supports the work and adds depth features.
- - Subscriptions auto-renew until you cancel. You manage and cancel them in your App Store or Google Play account — not inside everQUIN.
- - Your data lives on your device. There are no accounts. See the Privacy Policy.
- - Use the app as intended. Don't break the law with it, and don't try to defeat its purchase or licensing.
1. Acceptance
By downloading, installing, or using everQUIN ("the app"), you agree to these Terms of Use. If you don't agree, don't use the app. If you use the app on behalf of someone else, you confirm you're authorized to accept these terms for them.
2. Who can use the app
The app discusses mortality, relationships, and self-knowledge and is intended for adults. Children under 13 should not use it. If you're a minor in your jurisdiction, use the app only with the involvement of a parent or guardian.
3. What the app is — and is not
everQUIN is an educational and reflective practice tool built around the everQUIN framework. It is provided for personal growth and self-reflection.
The app is not a substitute for professional care. It does not provide medical, psychological, psychiatric, therapeutic, legal, or financial advice, and nothing in it creates a clinician–patient or professional relationship. The framework's commentary, prompts, "I'm stuck" responses, and any reflective content are general and not tailored clinical guidance.
If you are in crisis or may harm yourself or others, stop and contact your local emergency number or a crisis line immediately. In the US you can call or text 988 (Suicide & Crisis Lifeline). The app cannot and does not monitor your wellbeing or summon help.
4. Your account and your data
The app has no user accounts and no server-side profile. Your content is stored on your device. You are responsible for your device, your backups, and anything you export or share. Deleting the app, or using the in-app "Delete all data" control, removes your local data and is irreversible. How data is handled is described in the Privacy Policy, which is incorporated into these terms by reference.
5. Purchases, subscriptions, and billing
The canon and the first 90 days of practice are free. Optional paid offerings are:
- - Patron — an auto-renewing subscription (monthly or yearly) that sustains the work and unlocks depth features (annotated study guides, unlimited qLENS tiles, beyond-day-90 cycles, long-window insights, and a Patron mark).
- - Lifetime — a one-time purchase granting the same content access permanently, with no recurring charge.
All purchases are processed by Apple (App Store) or Google (Google Play) under their terms. We do not receive or store your payment details.
Auto-renewal. Subscriptions automatically renew at the then-current price for the same period unless you cancel at least 24 hours before the current period ends. The renewal charge is applied to your store account within 24 hours before the period ends.
Cancellation. Cancel anytime in your store account:
- - iOS: Settings → your name → Subscriptions.
- - Android: Play Store → Profile → Payments & subscriptions → Subscriptions.
Cancelling stops future renewals; you keep access through the end of the paid period.
Refunds. Refunds are handled by Apple or Google under their policies, not by us. We can't issue store refunds directly.
Price changes. If we change subscription prices, the store will notify you and, where required, ask for your consent before the new price applies. Free content stays free.
Restore. "Restore past purchases" re-applies a purchase or active subscription tied to the same store account. Purchases are not transferable between different store accounts or platforms.
6. License
Subject to these terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, as allowed by the App Store or Google Play terms. On iOS, the Apple Licensed Application End User License Agreement (the standard EULA at <https://www.apple.com/legal/internet-services/itunes/dev/stdeula/>) also applies, and where it conflicts with these terms for the iOS app, that EULA governs the conflicting term.
7. Intellectual property
The everQUIN framework, the canon text, the app's design, code, copy, and brand marks are owned by the everQUIN team or its licensors and are protected by law. These terms don't transfer any ownership to you. Content you create (your journal entries, marvels, ring data, reflections) remains yours; the app does not claim rights to it.
8. Acceptable use
Don't:
- - reverse engineer, decompile, or tamper with the app except where the law expressly permits;
- - circumvent, disable, or defeat purchase, licensing, or entitlement checks;
- - use the app to break the law or infringe anyone's rights;
- - resell, redistribute, or commercially exploit the app or the canon without permission.
9. Third-party services
The app can open external services you choose — your device's share sheet, your store's subscription management, your browser for these documents, and an optional, coarse weather lookup. Those services have their own terms; we're not responsible for them.
10. Disclaimers
The app is provided "as is" and "as available," without warranties of any kind, to the fullest extent the law allows — including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the app will be uninterrupted, error-free, or that any outcome will result from using it. You use the framework and the app at your own discretion and risk.
11. Limitation of liability
To the fullest extent permitted by law, the everQUIN team is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, arising from your use of the app. Where liability can't be excluded, it is limited to the greater of the amount you paid us for the app in the 12 months before the claim, or USD 50. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
12. Changes to the app and these terms
We may update, suspend, or discontinue features. We may revise these terms; when we make material changes we'll update the "Last updated" date and, where the change is significant, notify you in-app. Continuing to use the app after changes take effect means you accept the revised terms.
13. Termination
You may stop using the app and delete it at any time. We may suspend or end your license if you materially breach these terms. Sections that by their nature should survive (intellectual property, disclaimers, limitation of liability, governing law) survive termination.
14. Governing law
These terms are governed by the laws of the jurisdiction in which the everQUIN team is established, without regard to conflict-of-laws rules, and subject to any mandatory consumer-protection rights you have where you live. _(Set the specific governing-law jurisdiction and venue before publishing.)_
